If you suspect that you are under investigation by your employer, you are not without rights. For example, you have the right to contact HR and request clarification as to why you are being investigated, including the specific allegations against you, although your employer is not obligated to inform you. You also have the right to present your side of the story. You should, of course, think through your situation before you submit to an interview, which should include talking with an employment lawyer. And most importantly, you have the right to a fair and impartial investigation by your employer.
Depending on the particular circumstances and company policy, you may also have the right to have a representative (an attorney or a union representative) present during the investigation. Even if you are not allowed to have an attorney present, it is wise to consult with an employment attorney during the investigation to prepare for any legal implications from the investigation.
Adhering to all company policies and procedures throughout the investigation is crucial. Provide truthful answers to all inquiries and maintain the confidentiality of the process.
