Unpaid Wages and Overtime

The law is clear.  Under both the Fair Labor Standards Act and the Connecticut Wage Act, if you work more than 40 hours a week, you are entitled to time-and-a-half as overtime compensation.  The only exceptions are if you are properly classified as an exempt employee.

Employers often try to get around the law.  Among other things, employers may try to avoid the payment of overtime compensation by:

  • improperly classifying an employee as “exempt” from the payment of overtime;

  • having employees work “off the clock;” 

  • "shaving" time from the employee's time card;

  • paying employees “straight time” for overtime hours worked; or

  • averaging the hours worked over a two week period.
