Were You Discriminated Against Because Of Your Age?

Do you think you were fired because of your age?  If so, what can you do about it?

 

According to the Equal Employment Opportunity Commission, more than 60% of employees over the age if 45 have experienced or witnessed age discrimination in the workplace.  Under the Age Discrimination in Employment Act, 29 U.S.C. Section 621 et seq., it is against federal law for employers with at least 20 employees to take an adverse employment action against an employee because that employee is over the age of 40.  It is not enough that the employee is over 40; there must be some evidence that the reason for the adverse employment action was the employee’s age.

 

Age discrimination can take many forms.  For example, an employer can hire mainly younger employees or terminate mainly older employees.  An employer also could repeatedly claim that older employees are overqualified for a position or pass over older employees for promotions in favor of less qualified younger employees.
